Reading the comments on the PbS comic reminded me of how many people want to "control the narrative" on the McD's coffee spill case. She was in her grandson's very small sports car. She was pretty old [late 70s, early 80s??]. She didn't get sugar in her coffee because she wanted to put her own desired amount in.

The grandson pulled out of the way and stopped. She put the coffee between her thighs in a very small seat. When she pulled of the lid the very hot [but drinkable by the way, if you use care] it spilled in her crotch [she probably jerked in reaction to a small spill making it very large]. She couldn't get out of the seat quickly. Her old skin was very vulnerable [trust, mine is getting that way]. The very hot coffee remained in direct contact with her very fragile skin for quite some time. Result: pretty bad burn.

Okay. Why did McD's refuse to 'settle' for just paying her medical expenses? Well, they hadn't actually done anything wrong. At several points, had she made different choices the problem wouldn't have existed. Secondly, settling would most likely have made them a target for future suits. As it stands, after the eventual reduction of damages on appeal they sent a very strong signal about suing them "on the cheap".

However, rather than fight it further they just screwed up their coffee. I get Taco Bell coffee once in a while [it's convenient, relatively cheap, and tastes okay] and it's still served blazing hot. So the whole fast food world hasn't gone to luke-warm coffee.

Had I been on that jury it would have been hung at best.
