Kennedy is a genius at apply reality checks to "accepted practice". And he has a fine hand when it comes to researching topics, and likely a very astute staff to dig into the material. But Kennedy couldn't present it so clearly unless he understands it.

And as SCOTUS is (at least) partially to blame* for this ongoing lawfare, Trump telling Roberts to buzz off is entirely appropriate. It would certainly trigger all the right people, though. But they still could have the option of class action suits.....
The abstract implications of this debate go back to Plato and Aristotle. Continental Europeans tend to favor Plato and that's what really underpins our differences with them. The Scottish philosopher David Hume threw a spanner in the works, and we've been arguing about it ever since. The concept of reason is a sticking point, this is a good summary:

Plato would disagree with you. He argued, starting with the unchanging truths of geometry, that laws based on *reason* ARE divine revelations, but only some individuals with special training can access these truths. Our system of independent judges does seem to be based on this. Obviously we've reached the limits of utility of this idea.
