  3. I'm not sure about the sueing part, but after hearing the description of the incident, I could understand a driver being traumitized by something like that. That's assuming the driver didn't intentionally try to hit the jogger(s).

  4. I read a comment somewhere that suggested the possibility that the driver's insurance company may be compelling the driver to sue the estate in order to qualify for payment of health care claims. Could be, but I've got to tell you: I'd eat the cost rather than do this.
